Membership Agreement

IN CONSIDERATION of the mutual covenants and conditions contained herein, the parties agree as follows:

Member shall pay the dues for one individual membership lasting until the expiration of entry card, being billed on monthly intervals, or the additional sums to add additional family memberships. In addition to the regular dues, members are required to pay a member activation fee established by the Center. The activation fee is waived on subsequent renewals as long as the renewal is paid within 30 days. Family shall be defined as those persons related to member by affinity or consanguinity and living in the member's household.
In exchange for the current dues as stated, the member shall be entitled to use the facilities of the Center subject to the provisions hereof. Member agrees to pay all court costs, and a 10% monthly penalty charge for any unpaid balances due the Center. All payments to the Center, are in equal monthly installments spread over the entire term of this contract; and the term of this contract is stated above and is not capable of being extended.
Member, his family, and his guests shall exercise a reasonable degree of care and caution with respect to the use of the Center's equipment so as to avoid harm, damage, or injury to any of the property or equipment belonging to the Center or any other person. Any such harm, damage or injury caused by the negligence, intentional or willful misconduct of the member, his family, or his guest shall be that member's sole responsibility. The center shall not be the bailee nor assume responsibility for any property belonging to member, his family or guests used or left at the center.
Member agrees to hold the Center, its owners, or any employees or contractors thereof harmless from any harm or injury received by the member, his family, his guest, or any other person as a result of the member's use of any of the equipment or property located at the center, whether belonging to the Center or some other person, and shall indemnify the Center, its owners, or any employee or contractor thereof for any expenses or costs resulting there from.
Member agrees to abide by all rules and regulations established by the Center from time to time, and shall insure that his family, and his guests do the same. Said rules and regulations shall be established in the sole discretion of the Center and shall be reasonable designed to preserve the safety of the occupants and the equipment therein.
IN THE EVENT THE HEALTH SPA FACILITY CLOSES AND ANOTHER HEALTH SPA FACILITY OPERATED BY THE SELLER, OR ASSIGNS OF THE SELLER, OF THIS CONTRACT IS NOT AVAILABE WITHIN FIVE (5) MILES OF THE LOCATION THE MEMBER INTENDS TO PARTONIZE, SELLER WILL REFUND TO MEMBER A PRORATA SHARE OF THE MEMBERSHIP COST, BASED UPON THE UNUSED MEMBERSHIP TIME REMAINING ACCORDING TO THE CONTRACT. Center also reserves the right to upgrade, move or delete any &/or all equipment and services at the discretion of the Center.
The Center reserves the right to cancel the membership of any member at any time. If, in its sole discretion decides that member, his family, or his guests, do not conform to the standard of conduct set forth for the members. The Center is not obligated to refund membership fees paid, except as stated in section 6 above.
Each member shall be issued a card and shall be required to use the card to enter and exit. Member shall have said card in member's possession each visit at the Center .
No membership in the Center may be assigned or transferred without the prior written consent of the owners of the Center.
This contract contains the complete, final, exclusive agreement of the parties with respect to the terms hereof and any prior agreements, representations, or statements made by the owners of the Center, or any employee thereof are hereby superseded and merged herein.
Member must get prior permission to take a guest and there is a five dollar charge. Guests are on a one time basis only. Two or more days they must pay the weekly rate of $25.00 through the normal membership method.
YOU, THE CONSUMER, MAY CANCEL THIS CONTRACT AT ANYTIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE ON WHICH THE CONTRACT IS EXECUTED. FULL REFUND IS GUARANTEED.

MOAB FITNESS CENTER RULES

Do not loan out or let anyone else use your entry card.
Absolutely no guests or anyone is permitted in the Center without obtaining prior approval from the management. Do not let anyone in for any reason.
Weight plates are to be replaced on the weight racks in their respective weight categories. No weights or attachments on floor or leaning on walls.
Put up all weights left out by you and others before you leave.
Do not move the equipment around in the Center. All benches, machines, etc. are to stay where they have been arranged by management.
No tobacco products or alcoholic beverages are to be used on the premises. This also includes the parking area.
Equipment pertaining to aerobics, karate & other classes are not to be used by members.
No equipment or weights are to be taken into the aerobic exercise area.
Use the equipment with respect and care. You are responsible for it!
The Center is not responsible for any personal items brought to or left at the Center.
Double check exit doors to make sure they are shut and locked.
Do not prop open the Center's doors. Keep all doors closed and locked.
Use spotters on all free weights. All members are required to spot for others.
You must comply with all rules posted in the Center.
For tanning bed use: There is a 30 minute limit. You must clearly print your name on the sign in sheet or your entry card number. Tanning beds cause skin cancer. Use at your own risk. Wipe clean with disinfectant before and after use. Only use tanning bed lotions. Normal lotion will ruin the plastic screens.
No equipment or any other items belonging to Moab Fitness Center may be removed from the premises.
No dogs, cats, or animals of any kind are permitted on the premises.
No street shoes or street clothing permitted. You must change your clothes and remove your street shoes in the changing rooms prior to entering the workout areas (that's entry door #2). Your exercise gear must be clean. This includes your body! You must wear a shirt, pants, shorts, shoes, to work out in at all times. Absolutely no denim or blue jeans or other clothing with sharp buttons, etc.
Chalk is not permitted in the Center.
Wipe clean all machines and surrounding area after use.
Report lost or misplaced cards immediately. You are responsible for theft or damage done if your card is used to gain access to the Center and you failed to report it to us.

Gym Shoe Policy

I understand and agree to purchase a New pair of gym shoes to be used exclusively inside Moab Fitness Center .
I agree to hand carry the shoes into the Center with me or keep them in my locker if I have one.
I agree to not wear the shoes anywhere other than inside the Center.
I agree to change into these gym shoes in the front changing rooms prior to entering the exercise areas.
I understand if I wear unacceptable footwear in Moab Fitness Center, my membership will be canceled and I agree to forfeit all paid up fees.
I agree to wear proper gym clothes. No blue jeans, or other clothing items with sharp buttons, seams or abrasive materials.

Door Security

You must use your card every time to enter and exit the Center. Failure to use it to exit will deactivate your card.
Do not follow others in before the door closes. Let the door close completely after each person enters.
Do not let anyone follow you in for any reason. Make sure the door completely closes after you enter.
I agree to pay Moab Fitness Center a $50.00 fee for each person I let follow me in, even if they have a Fitness Center card in their hand.
